This Agreement outlines the data protection and privacy obligations which Mid-Missouri PrideFest, Inc. (“Data Controller”) adheres to in compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679.

1. Definitions:

   • “Personal Data” means any information relating to an identified or identifiable natural person.
   • “Processing” means any operation performed on Personal Data, whether or not by automated means.
   • “Data Subject” means the identified or identifiable natural person whose Personal Data is processed.

2. Compliance:

   • The Data Controller shall comply with all applicable GDPR regulations regarding the Processing of Personal Data.

3. Data Subject Rights:

   • The Data Controller shall respect the rights of Data Subjects under GDPR, including but not limited to their right to access, right to rectification, right to erasure, and right to data portability.

4. Data Processing and Security:

   • Personal Data shall be processed lawfully, fairly, and in a transparent manner.
   • Personal Data shall be collected for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes.
   • The Data Controller shall implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk.

5. Data Breach Notification:

   • In the event of a Personal Data breach, the Data Controller shall notify the appropriate supervisory authority without undue delay and, where feasible, not later than 72 hours after becoming aware of it.

6. Third-Party Processors:

   • Where the Data Controller uses third-party processors to process Personal Data, such processors will be bound by written agreements to provide an equivalent level of protection as set out in this Agreement.

7. International Data Transfers:

   • Any transfer of Personal Data outside the European Union shall be done in compliance with the provisions of the GDPR.

8. Amendments:

   • This Agreement may be amended or updated in accordance with the evolving legal and regulatory framework pertaining to data protection and privacy.
